1. Personal Data Protection Policy
In compliance with the provisions of the (EU) Regulation 2016/679 of the European Parliament and Council, of April 27, 2016, regarding the protection of natural persons concerning the processing of personal data and the free circulation of this data, and which repealed the Directive 95/46/EC (General Data Protection Regulation), and under the provisions of Organic Law 15/1999, of December 13, governing the Personal Data Protection, COMERCIAL SAUTA S.L. informs the User of the existence of a personal data file created with the details obtained in the web page by and for COMERCIAL SAUTA S.L. and under their responsibility. The Spanish Data Protection Agency has been duly informed of this file. Said file has been created with the aim of providing information and rendering the services offered on the Portal, as well as undertaking marketing and advertising activities by whatever means, including sending electronic mail. In the event of carrying out marketing and advertising activities via email, the express consent of the user will be solicited pursuant to the provisions of Law 34/2002 of 11 July, of Information Society Services and Electronic Commerce.
1.1.- Consent of the User: The User expressly accepts the inclusion of his/her personal data gathered during browsing on the Portal, or provided through the completion of any form contained in the Portal, in an automated personal data file referred to above. During the process of data collection, and in the place of the Portal where such is requested, the User will be conveniently informed by hyperlink or by including the information in the form itself, of the obligatory nature of collecting such information for the provision of services as well as for the present rights.
1.2.- Rights of the User: The User may, with regard to the details collected, exercise his/her rights outlined in Organic Law 15/1999 on Personal Data Protection and in particular the rights of access, rectification or cancelation of data and opposition, as well as withdrawal of consent to the transfer of his/her data or for any of the uses described above. 1.3.- Security measures: COMERCIAL SAUTA S.L. declares having adopted all the necessary and appropriate security measures provided for in the Royal Decree 994/1999, of 11 July by which it approves the Regulations on Security Measures for automated files containing personal data.
1.4.- Cookies: COMERCIAL SAUTA S.L. informs the User that to access any part of the contents of the Portal, it is necessary to fill in registration forms, or similar, beforehand, in which the user may be asked to enter personal data. Likewise, and in order to improve its services, COMERCIAL SAUTA S.L. may enable “cookies” whereby user data is obtained.
2.- Intellectual and Industrial Property. Hyperlink policy
2.1.- All content included on the Portal and in particular trademarks, trade names, industrial designs, designs, texts, photographs, graphics, logos, icons, software or any other features susceptible to industrial and commercial use are protected by the industrial and intellectual property rights of COMERCIAL SAUTA S.L. or of third party owners who have authorised their inclusion on the Portal. Any use and/or reproduction of these without the express consent of COMERCIAL SAUTA S.L. is expressly prohibited.
2.2.- COMERCIAL SAUTA S.L. will not be responsible for the infringement of intellectual or industrial property rights of third parties which might arise from including in the Portal trademarks, trade names, industrial designs, texts, photographs, graphics, logos, icons or software belonging to third parties which they may have declared as being owners of when including them in the Portal.
2.3.- Under no circumstances shall it be understood that access to and browsing by the User implies authorisation nor that a waiver, transmission, total or partial transfer of such rights or the granting of any right or expectation of right, and in particular, the alteration, transformation, exploitation, reproduction, distribution or public communication of said contents is effected without the express prior authorisation of COMERCIAL SAUTA S.L. or the corresponding owners.
2.4.- No relationship may be established with the Web Portal from any other web site without the previous and express consent of COMERCIAL SAUTA S.L. The links that are established must be made to the main page of COMERCIAL SAUTA S.L. or if applicable to that which COMERCIAL SAUTA S.L. establishes, said link being absolute and complete so that it brings the User to the website of COMERCIAL SAUTA S.L. which must fill the whole screen of the main page.
2.5.- COMERCIAL SAUTA S.L. shall not be responsible for the content of destination web pages that are established through links on the web Portal nor for infringements of rights of third parties in which said pages might incur.
3.- Responsibility of COMERCIAL SAUTA S.L.
The User acknowledges and accepts that the use of the web Portal and of its services are done under his/her whole responsibility. COMERCIAL SAUTA S.L. will only respond to damages that the User might suffer as a result of using the web Portal when said damages are attributable to malicious action of COMERCIAL SAUTA S.L. However, COMERCIAL SAUTA S.L. declares having adopted all necessary measures, within its capabilities and the state of the technology, to ensure the functioning of its web portal and to prevent the existence and transmission of viruses and other components that might be harmful to the User.
4. Obligations of the user
The User is obliged to use the contents of the web portal diligently, correctly and legally, and undertakes to refrain from: a) using the contents for ends or purposes which are contrary to the law, morality and to good customs or public order. b) reproducing, copying, distributing, permitting public access by whatever means of public communication, transforming or modifying the contents, without the prior authorisation of the owner. c) using the contents of the web portal to send advertising, information for purposes of direct sales or any other commercial purpose, unsolicited messages targeted to groups of persons independently of their purpose, and to refrain from trading or distributing the information in any from.
5. Commercial communications
COMERCIAL SAUTA S.L. may send commercial communications by any means that are fully compliant with current legislation on matters of personal data protection. For commercial communications sent by e-mail and in compliance with the provisions of Law 34/2002 of 11 July, governing Information Society Services and Electronic Commerce, the consent of the User will be duly obtained at the time of collecting the corresponding data. COMERCIAL SAUTA S.L. may send commercial communications by any means that are fully compliant with current legislation on matters of personal data protection. For commercial communications sent by e-mail and in compliance with the provisions of Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce, the consent of the User will be duly obtained at the time of collecting the corresponding data. 6. Applicable legislation
The relations established between the User and the owner of the web Portal are governed by what is stipulated in current regulations on applicable legislation and the competent jurisdiction. However, in those cases in which the regulations foresee the possibility of the parties submitting themselves to a jurisdiction, COMERCIAL SAUTA S.L. and the User, expressly renounce any other jurisdiction which might correspond to them, and submit themselves to the Courts and Tribunals of Guipuzcoa. In any event the regulations of the Spanish legal system shall be applicable.
